Your privacy is important to us. This Privacy Policy explains how we collect, store, use, disclose and otherwise process your information when you use the Verce mobile app, the Verce website, and the Linkpool by Verce website.

Please take some time to read this Privacy Policy along with our Terms of Use, in order to ensure you understand and are comfortable with our use and disclosure of your personal information. If you see an undefined term in this Privacy Policy, it has the same meaning given to it in our Terms of Use.

Please note that this Privacy Policy only applies to the Verce mobile app, the Verce website, and Linkpool by Verce website (together “Verce” or “Services). When using Verce, you may find links to other websites, apps and services, or tools that enable you to share information with other websites, apps and services. Verce is not responsible for the privacy practices of these other websites, apps and services and we recommend that you review the privacy policies of each of these websites, apps or services before connecting your Verce account or sharing any personal data.

If you do not agree to any of the provisions of this Privacy Policy, you should not use the Verce app or Verce webapp. If you have any questions or concerns about this Privacy Policy, you can contact us through our website verce.me or at post@verce.me

Information We Collect:

All the personal information we collect is related to providing Verce and its features and falls into two general categories:

- Information you provide to us

- Information we obtain from third parties

 

Information You Provide:

We ask for and collect the below personal information when you use Verce. This information is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations.

We process this information in light of our legitimate interest in improving Verce and giving our users the best experience, and where it is necessary for the adequate performance of the contract between us and you. Without it, we may not be able to provide you with all the requested services and features of Verce.

By registering for an account in Verce, you will need to provide us with certain information:

- your email address

- your real name

- an artist name or username

- information about how you categorize yourself with respect to your content (for example, whether you are a musician, a label or some other category of creator)

If you like you can add a profile picture, bio with information of your choice, years of experience and nationality. Any additional information you provide as part of your public profile, such as links to your website and other social media profiles (but not your email address), will be published on your profile page. Please bear this in mind when considering whether to provide any additional information about yourself.

Communications:

When you communicate with Verce by email or through our services, or use the services to communicate with other users, we collect information about your communication and any information you choose to provide.

Information You Post:

When you post projects, services or any other data in Verce, we collect that information. We do not allow you or any other individual to include any personal information in the data/content you share with the other users of Verce.

Information From Third Parties:

Facebook – Verce allows you to sign up and sign in using your Facebook account. If you sign up using Facebook, Facebook will ask your permission to share certain information from your Facebook account with Verce. This includes your Facebook user ID, first name, last name and email address. This information is collected by Facebook and is provided to Verce under the terms of Facebook’s Privacy Policy. You can control the information that we receive from Facebook using the privacy and data settings in your Facebook account.

Apple – You can also sign in using Apple. When you use this option to sign in, Apple provides us (Verce) your name, and your email address. If you choose to not share your email, we’ll receive an auto-generated email by Apple, which will forward the email to you if it receives an email. Apple will not track you or any users as they interact with Verce.

How We Use Your Information:

We use the personal information we collect from you, including with the help of automated systems and decision making, for a range of different business purposes according to different legal bases of processing and subject to the choices you make in your Settings.

Provide, Improve, and Develop Verce:

To operate and maintain your Verce account, and to provide you with access to and use of the App. Your email address and password are used to identify you when you log into the App. If you have a user in Verce you can access the services with your account from any device that supports the services. 

To identify you as the creator of your uploaded music/sounds, the comments that you post and/or the other contributions that you make to the App.

Your email will be used to send you service updates and notifications about your account.

To respond to you about any comment or enquiry you have submitted.

All users should be at least 16 years old. 

We process this information in light of our legitimate interest in giving our users the best experience, improving the product and where it is necessary for the adequate performance of the contract with you.

Verify and authenticate your identity and prevent unauthorized or illegal activity.

Detect and prevent fraud, spam, abuse, security incidents, and other suspicious activity.

Enhance the safety and security of our products and services.

Conduct security investigations and risk assessments.

To prevent or take action against activities that are, or may be, in breach of our Terms of Use, Community Guidelines or applicable law.

To provide you with customer and technical support.

We process this information in light of our legitimate interest in improving Verce and giving our users the best experience, and where it is necessary for the adequate performance of the contract with you (e.g. Terms of Use).

Sharing of Your Information:

This section describes how the information collected or generated through your use of Verce may be shared by you or by us. 

Through Your Profile:

Any information in your public profile (other than your email address) will be accessible by all accounts and users of Verce, who may view your profile information, listen to and find any of your public audio files, and send you messages. If you listen to any audio files uploaded by another user, the fact that you have liked/commented on those audio files will be shared with that user. 

With Your Consent:

We will disclose your information if you have agreed that we may do so. We will make this clear to you at the point at which we collect your information, including the purpose(s) for which we will use the data.

Service Providers:

We use a variety of third party service providers to provide services to us or to our users on our behalf. These service providers have access to your information solely to perform these tasks on our behalf, and are contractually bound to implement appropriate organizational and technical security measures to protect against unauthorized disclosure of personal data, and only to process personal data in accordance with our instructions and to the extent necessary to provide their services to us. We need to share your information in order to ensure the adequate performance of our contract with you.

Content Partners:

Verce allows you to listen to a variety of content, including licensed streaming content from our content partners. We share information with these content partners that license this content to help them understand how the content they provide is performing, including insights about general user listening trends and preferences. We use technical measures to ensure the data is de-identified and/or aggregated so it does not identify you directly. We share this data based on our legitimate interest in helping content partners deliver high performing content and to ensure the fulfillment of our contract with those partners.

Third Party Applications:

If you choose to connect your Verce account to other apps or social networks, you may be sharing certain information with these apps or networks. We also use some third-parties for other functionality described here.

- Sign in with Facebook - When you sign in with Facebook, we receive your public profile-information, as well as your email. The Facebook SDK can collect the following information when you use Facebook Login:

* App Events: This covers generic App Events (e.g. App Install, app launch) and other standard logging for product metrics (e.g. SDK loading and SDK performance).

* Configuration data: After a user has logged in, the SDK makes periodic background requests to manage the lifetime of the access token automatically.

* Error information: The SDK captures error information, including during initialisation of the SDK, which may include a user ID of individuals who are logged in to Facebook.

* Short-term data: The SDK measures some user activity for purposes of managing fraud and abuse. This data is only retained for a very short period for those not logged in to Facebook.


- Sign in with Apple - You can also sign in with Apple. When you use this option to sign in, the only information we get from Apple is your name (if you allow it), and your email address. If you choose to not share your email, we’ll receive an auto-generated email by Apple, which will forward the email to you if it receives an email. Apple will not track you or any users as they interact with Verce.

- Google Analytics for Firebase (Mobile app) - In our mobile app, we use Google Analytics for Firebase to analyze how our users are using the app. GA for Firebase uses some personal data to function properly. They are using your devices advertising-id (Mobile ad IDs called IDFA in iOS and AAID in Android), which allow developers and marketers to track activity for advertising purposes, aswell as they can be used to enhance serving and targeting capabilities. They also take advantage of the phone's device identifiers (IDFV in iOS and Android ID in android), which identifies the device to the app’s vendor. They also automatically generate and assign an app-instance ID to each instance of your app. The ID is used to compute user metrics throughout Analytics. You have the option to allow or disallow this behaviour by turning on/off the “Analytics”-section in your Privacy-settings.

- Google Admob for Firebase - In the mobile app, we use Google Admob for Firebase and their partners to display ads in order to keep the product free. Google and their partners will use your advertising-id (IDFA/AAID as described above in “Google Analytics for Firebase”) to serve personalized ads and track your usage of Verce, if you allow Personalized Ads within your privacy settings.

- Plausible Analytics - When you use our website we are anonymously tracking your behaviour on our site, using Plausible Analytics (PA). PA creates detailed reports about the users behaviour and the performance of our site, so that we can optimize our product even further. All data is completely anonymized to ensure your privacy.

- Daily.co - Across our platform you can video call your collaborators using Daily’s video call system which is embedded in our platform. When you do, Daily collects some data. They collect your settings (for example your most recently specified camera and microphone state), your usage data (for example when you joined/left a particular video call), and performance data (including and limited to network bandwidth and if there were any audio issues during a call).

- Pollfish - This website uses Pollfish web plugin. Pollfish is an on-line survey platform, through which, anyone may conduct surveys. Pollfish collaborates with Developers of applications for smartphones and website owners in order to have access to users of such applications/websites and address survey questionnaires to them. This website uses and enables Pollfish cookies. When a user connects to this website, Pollfish detects whether the user is eligible for a survey. Data collected by Pollfish will be associated with your answers to the questionnaires whenever Pollfish sends such questionnaires to eligible users. For a full list of data received by Pollfish through this website, please read carefully Pollfish respondent terms located at https://www.pollfish.com/terms/respondent. By using this website you accept this privacy policy document and you hereby give your explicit consent for the placement of a Pollfish cookie (described in our Cookie Policy) in your system and the processing by Pollfish of the aforementioned data. Furthermore, you are informed that you may disable Pollfish operation at any time by using the Pollfish “opt out section” available on Pollfish website or by disabling “third party cookies” from your browser’s settings. We once more invite you to check the Pollfish respondent’s terms of use, if you wish to have more detailed view of the way Pollfish works.

- Hotjar - We use Hotjar in order to better understand our users’ needs and to optimize our service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies (described in our Cookie policy) and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.

Compliance with Laws:

We may disclose your information to courts, law enforcement agencies, and governmental authorities to comply with our legal obligations, to comply with legal process and to respond to claims asserted against Verce, to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability or to enforce and administer our Terms of Use and other agreements with users.

Change of Control:

We may also share your personal data as part of a sale, merger or change in control of Verce, or in preparation for any of these events. Any other entity that buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.

Information Security:

Verce maintains technical, administrative, and physical safeguards that are designed to prevent unauthorized access, use or disclosure of personal information we collect or store. However, it is not possible to guarantee the security of information transmitted over the Internet.

Data Access and Portability:

You may be entitled to request copies of your personal information held by us. While a lot of the personal information you provide to us can be accessed in your account Settings, you may also be entitled to request copies of personal information you have provided to us in machine-readable format.

Change or Correct Data:

Where you cannot update data yourself through an account, you have the right to ask us to correct, change, update or rectify your data.

Data Retention and Deletion:

Deleting Your Account – If you have an account and would like to delete it, you may do so by in your Settings in the Account tab. If you delete your account, all data associated with your account (except for backup copies), including the sound files that you have uploaded and the usage data associated with those sound files, will be deleted and may not be recoverable. We therefore advise you to copy or backup all content uploaded to your account before deletion. Even if you delete your Verce account, it is possible that your information may still show up in some internet search results for a short while afterwards, if the search engine maintains a temporary cache of web pages. Search engines’ caching processes are outside of Verce’ control and therefore we cannot be responsible for any information that remains cached by search engines after that information has been removed from Verce. Please note that deleting the Verce App, will not delete your account.

We generally retain data for as long as your account is in existence or as needed to provide the services of Verce. However, specific retention times can vary based on context of the processing we perform and on our legal obligations.

You have the right to ask us to delete all or some of the personal data we hold about you. If you have an account, you can also delete your account through the Settings at any time as described below.

We may need to retain some of your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations, or where we have a legitimate interest in doing so (e.g. to prevent fraud and abuse and maintain and enhance security).

Withdrawing Consent:

Where you provide consent to the processing of your personal information by Verce, you may withdraw your consent at any time by changing your account Settings or by sending a communication to Verce specifying the specific consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before the withdrawal.
